    It is true that ordinary americans does not care about immgration because those who are working in high tech and engg are very less may be less than 20%. So the impacted people are americans those who are aspiring to become High tech employees and those who were laid of from high tech. They want just some kind of protection and preference for their jobs from H1bs. This argument cannot be ruled out completely. Right now some protectons like LCA and Labor certification process,We everyone know those process are just formality and documentation and not implemented really. Why I am telling this is lot of congressmen buying this argument and opposing H1b and gc increase. If these kind of issues are resolved h1b and green card can be increased without much opposition. But IV cannot do anything about the H1b issues or protecting american jobs as it is out of scope. But Corporations and Congress can do that. We knew for jobs in India Indians are given preference so nothing wrong in thinking of American that they should be given preference.




    Spot on. i think the anti-immigrants grossly magnify the hue and cry over H1-B abuses. Most americans dont know what H1-B is and nor do they care. The only immigrants they have heard about are the illegal kind. Ordinary americans are mostly indifferent to legal immigration. Politicians care first for their votebanks (present and future) and second for their sources of funding aka corporate lobbies. They are the ones who have the ability to make a difference.

    There are some things that the seeker calls rights and the person who grants them calls them privileges. If you want to be forceful, you have to call it a right, not a privileges.

    100% agreed. Illegal immigrants do not have any rights/privileges. But they are bold, turn up in thousands on the street and protest for their (non-existing) rights. We can take a cue from the illgeal immigrants. All it comes down to is unity and putting forth a collective voice so that grievances of legal immigrants could be heard by the polticians.

    Well ... I could partially agree to your rant. While I understand your point of view it is not justified on your part to generalize all posters into one category. You should have been more specific about what kind of posts (and even posters if you wish) frustrate you.

    In my view your words "Get a life" certainly applies to the following set of people (in that particular order):


    Those who say they are awaiting their GC to plan their lives (get married, have kids, buy a house etc.) I am married with a kid and bought a house and all I have is a I-140 approval (Not applied for I-485 yet). So what happens if I loose my job? I will make an honest effort to find one and if I fail I'll sell my house and go back to India. I am prepared both mentally and somewhat financially too. As much as I want to live in the USA it is common sense that I always have a solid back up plan to go back if need be.

    Those who come here whining about their I-485 getting rejected and don't have a back up plan. Seriously, how many times must you get jacked before you realize that USCIS is not dependable? How the heck can one plan their life around it? One must realize that GC is just a small part of your life and not your life itself. Get your priorities straight.

    Those who say that laws are racist. Hilarious! BTW racism is not one way (like the Whites out here want you to think) so beware of what you say unless you don't mind getting sued.

    Those who build up their hopes with predictions on the next visa bulletin and go emotionally crazy when the hopes crash with the release of that bulletin. I mean c'mon ... flower campaigns? hunger strikes? Are you that naive to think it worked the first time? This ain't a factory in India and we aren't a group of union workers.


    The above form a very small group of people on this website and that is where the problem lies with your post. You are basically stereotyping all of us into a category formed by a small group of people.

    Anyway, good to know of your Canadian PR success ... good luck!

    To those who fall in the above 4 categories take the time to realize that its all in your head. Be strong and prepared mentally. You've done all you can in an honest way. If things don't work out then so be it. Sometime in the future you will realize that it was all for your own good. Move on in style to your next adventure ... it's waiting for you.

    A very sensible post. You dont need to have ur life around the GC and Priority dates. You need to do what u want to as much as within ur limits.. But one thing is USCIS can be staright forward and say EB-I wont move for such and such time and people can still plan better... :)

    This is in reference to a thread about feeling depressed by retrogression or labor backlogs to stuck FBI namechecks or whatever it is that depresses you. Not criticizing anyone in particular so dont aim for me.

    Yes, and a lot of people know that there are highly skilled people who are depressed and that takes a toll on employee productivity.

    After all, if 90% of your time is spent on thinking about BECs and visa bulletins, imagine if that time was spent on doing the job they've hired you for.

    Some employers(like Microsoft) realize this and want to do something about it. Its not just about keeping the best and brightest here in USA. Its also about keeping the morale and productivity up.

    As to how to deal with this...try this.

    Call your local congressman's office(Find out info about that from House.gov, with your zipcode). Get an appointment with congressman. There is an Easter recess coming up when they would be back from DC.

    Then talk to him about all issues you have. Take all the material you need from the "Volunteer" menu item of this website.

    Doing something about the problem is the best therapy there is. I am not saying this because I want to coax you into meeting your congressman. No. That's not the objective. But I think action is the best remedy for this problem. And there is actionable stuff to do about this. If you are suffering from terminal cancer, then you really cant do anything about that. This is not such a problem. This is a problem for which the solution is out there.

    Somehow, after landing in this country, people lose the appetite for risk and adventure. Before they are in here, they would move mountains to score an H1 or an F1. After coming here, they hunker down, heads-under-the-desk kind of approach. What I am talking about is nearly 200 people right now, who have read this post, but havent logged in. They wouldnt log in. They wouldnt give their real email address if they sign up. They would never contribute. WHY? Because they are afraid. That they will be deported. For no reason. Everything we do is legal, including raising funds and spending it on lobbying. But they are afraid. They are also afraid that by talking to congressmen, they will make them mad and the congressman will pick up the phone, call USCIS and then get their 140 cancelled. Yes. People create their own fastasies and become afraid of them..

    Yesterday, nearly 2000 Irish illegals went to capitol hill (http://www.ireland.com/newspaper/frontpage/2007/0308/1173121325488.html)and talked to various lawmakers to lobby for CIR and legalization. They were illegals. Yet, the somehow managed to walk into the building where laws of this country are made, talk to people who make the laws that they have broken, go thru Capitol Hill security check, and look into the eye of the lawmaker and talk to them.

    However, our community, this is how they behave. Forget about talking to congressman, or contributing money. When they call the core group with a question, they block the caller id can call. Dont disclose their name too. Ask a questions and then quickely hang up. Some of them want to contribute with cash because they are not willing to believe us that we are doing everything legal here and its their right to lobbying and petition the Government for problems.

    After paying taxes, after following all immigration laws, after getting all the education in the world to become "Highly skilled", the highly skilled cant bring themselves to stand-up with a straight spine, thump their desk and talk to their lawmaker.

    So at the end of the day, if we are depressed that legals dont get attention, then you know where to look for blame : the highly skilled who are highly educated and too afraid because their education and skills make them think too much and analyze too much, and they are afraid all the time.

    logic, Very interesting to read this..good post.... but this got me thinking in retrospect; how many of us have voted back home? How many of us know how laws are made back home or made an effort to become involved in the law making process back home? Other than for a favour I wonder how many have picked up the phone and dialed the MLA or MP ("our" lawmakers in the true sense) on a law making issue. How many of us have filed taxes or even know what filing taxes means back home? :) Guys, don't aim for me, I am just reflecting on the views put forth in in logic's post. My point is, being judgmental is not going to get anybody anywhere. I am not really sure who is afraid..who isn't etc. Perhaps none of us has the courage to hang our boots here, go back and become the next LN Mittal or Bill Gates?..open the next Microsoft, Oracle etc :)?. I admit that I definitely don't have the courage otherwise I definitely wouldn't be here in the first place. The "their lawmaker" quoted somewhere in the above post doesn't hold good in the true sense. The most promising solution is to approach the CEOs of big businesses so they can contact "their lawmakers". I know that employees in Microsoft have approached and talked to Bill Gates on this issue. I will try to do the same at my employer. Let us all do that with our respective employers. I know that we will be afraid to do this and it is natural...after all things could backfire and we might get fired for talking to the CEO :-).

For example, instead of undocumented aliens, I used the opportunity to stress the difficulties of employment-based applicants. While I have nothing against them, it is my belief that I need to stress my own problem and seek a resolution.

    And, I have also forwarded the link and my mail to all my friends who are waiting for green cards. More importantly, I have asked my relatives and friends, who are citizens or who have green cards, to pitch in and write for our sake.

    My suggestion, should you agree with the above, is not only to write to your Congress members but also ask your relatives and friends to do likewise.

    Actually, not all he said was wrong.
    We should not support what these IT consulting companies are doing with H1B programme just because we are on H1. These big companies are hoarding H1B visas so they can have an upperhand when dealing with the employees.

    My own employer was trying to get as many H1s as possible without having ANY work for them. They sent us all a few emails asking us if we had any family or friends back home who want to come to US on H1. These guys make the H1 applicants pay for the application expenses, then just keep them there or get them here and keep them on bench and almost everybody here is familiar with what happens next.

    Think from an American's point of view.. It is THEIR country, THEY make the laws that benefit their society and economy.. they have all the right to stand up against these practices by foreign based companies..

    I like his statement "H1B is supposed to be used when there IS a job but no American to do it" What these Consulting companies have turned it into is "There is a person on H1B avaliable If and when there is a job to do" OR worse "There is an H1B holder available, on bench, but no job to do"

    I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.

    Please don't fire me for taking his side, I'm not. I'm in favour of market deciding what it needs, but I'm 100% against fraud, and all of know these so called consulting companies ARE indulging in fraud..

    Guys , I think this issue has been discussed lot of times.
    1) USCIS do not allot immigrant visas, It is alloted by DOS.
    2) DOS needs a fix in the current EB laws to capture unused visa.
    3) I am not sure if we can push any change in law, given the current Iraq war quagmire.

    But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).

    Not sure USCIS keep up their promise with a large volume of applications. I came to know from immigration-law.com site that, 750,000 applications(yes,i'm talking about I-485) will be filed in this one month period. So, I'm really scared to imagine something good with such large volume.

    We should fight for recapturing unused visas and EB visa reform.
    Otherwise, we dont know how many more years we have to wait to get GC.

    Well per=country limit is part of the iNS law. So its legal.
    From an immigration perspective, green card is a privelege extended to "aliens" and it is the prerogative of the law to ensure a formula thats best for the country.
    INS family based immigration law was the one that conjured up the per-country limit to prevent folks from one country from flooding in. Unfortunately, this formula made its way into EB immigration and we are stuck with the consequences today.
    So if anything, we should bring up the fallacies in per-country limit as far as skill-based immigration is concerned and get the law changed.
    A lawsuit isnt the answer to everything. The chinese EB folks learnt that after spending thousands of dollars and few years on their lawsuit, the judgement they got back was that 'the law is being followed'.
    And the comment below about the constitution forbiding anything, with respect to immigration law, is pure nonsense.

    1. Constitution overrules any law and has the power to render any law invalid. No nonsense here (which means all that you said about INS,INA etc etc is nonsense)
    2. The last para is just your OPINION, so I let it pass
